SURFSIDE, Fla. – A class action lawsuit has been filed over the deadly collapse at Surfside. The lawsuit alleges that new construction next door damaged Champlain Towers South and contributed to the tragedy that killed nearly 100 people.

The complaint was filed on behalf of the living and deceased victims in Surfside. For the first time, it points the finger not only at entities directly connected to the Champlain Towers South, but alleges that the developer behind Eighty Seven Park Miami, an 18-story condo next door at 8701 Collins Avenue, bears some responsibility.

The developer, David Martin’s Terra, pushed ahead with the project, ignoring warnings about the damage it was causing to the Champlain South building, according to the civil suit.

UPDATED, Nov. 17, 12:35 p.m.: The Eighty Seven Park development team ignored warnings about the damage the tower’s construction was causing to the Champlain Towers South feet away, leading to the deadly Surfside condominium collapse, a new lawsuit alleges.

The complaint alleges that Eighty Seven Park developer Terra, led by David Martin, and its team of contractors and engineers pushed forward with building the luxury condominium “for the sake of greed, speed, or, most likely, both,” despite recommendations about safer methods from its own engineer, according to the suit. It states that the defendants’ “negligence and gross negligence” caused the tragedy.

The construction of a new luxury condo tower just feet away from Champlain Towers South caused severe damage to the fragile, poorly designed building in Surfside, eventually leading to the collapse that killed nearly 100 people, according to a civil complaint filed late Tuesday in a class-action case.

The 169-page complaint — filed in Miami-Dade Circuit Court on behalf of victims, survivors and their families — alleges that the development team at Eighty Seven Park ignored clear warning signs that its work posed a danger to the 12-story Champlain Towers South and failed to follow industry standards, presenting photographs, emails, internal documents and building plans to buttress its case. The construction took place between 2016 and 2019, several years before the collapse.

Miami Condo Collapse Victims Sue Next-Door Luxury Development

The catastrophic structural failure that led to the collapse of the Champlain Towers condominium outside Miami in June was linked to construction of a luxury high-rise development next door, according to a lawsuit filed by families of people killed in the disaster.

Developers of the Renzo Piano-designed Eighty Seven Park were improperly allowed to build higher and larger than originally entitled, according to the suit filed Tuesday in Miami-Dade County circuit court. The project site was sloped so run-off poured into Champlain Towers and undermined the building’s structural integrity, which was also damaged by excavation and pile-driving, the suit claims.

Lawsuit: Florida condo collapse triggered by building work

Construction of a luxury building next door triggered the collapse of an already fragile Florida condominium that killed 98 people in June, according to a new lawsuit.

The lawsuit, filed late Tuesday on behalf of Champlain Towers South victims and family members, contends that work on the adjacent Eighty Seven Park tower damaged and destabilized a building in dire need of major structural repair.

Champlain Towers, the lawsuit claims, “was an older building in need of routine repairs and maintenance, but it was not until excavation and construction began on the luxury high-rise condominium project next door” that the building became unsafe.
