David Rosendorf represents South Carolina utility customers who had filed a proposed class action in connection with an abandoned nuclear reactor project in the Chapter 11 bankruptcy of Westinghouse Electric Company, LLC, which was contracted to complete the project.  This case deals with the intersection of class action and bankruptcy law.

 

Barry Mukamal, as Bankruptcy Panel Trustee

Barry Mukamal is a panel trustee for the Southern District of Florida.  He was appointed as the Chapter 11 Trustee of American Resource Management Group, LLC/Resort Release, a group of timeshare exit companies.  The Chapter 11 case was filed with pending litigation between timeshare exit companies and the timeshare developers.  Corali Lopez-Castro and David Samole lead the Trustee representation to oversee the comprehensive transition of operations, handle pending litigation, pursue recovery of assets, and address the timeshare exit customers.

City of Coral Gables 2018

Cori Lopez-Castro represents the City of Coral Gables in many of its high-profile matters, including representing the City in defending its ordinance banning polystyrene. Ms. Lopez-Castro successfully obtained a final judgment in favor of the City entered by the Circuit Court in and for Miami-Dade County. The final judgment declares three Florida Statutes unconstitutional. The final judgment also determines that the City’s ordinances related to polystyrene regulation are valid and enforceable. The plaintiffs have appealed the final judgment.  The City is still waiting for an appellate ruling.  Ms. Lopez-Castro is also representing the City in its dispute with its utility provider, Florida Power & Light.  She was successful having the state court retain jurisdiction of the dispute.  Most courts abstain from considering the issues.  The matter against FP&L was settled after the Order on the Motion to Dismiss was issued.

Melanie Damian, as Receiver of Onix Capital, LLC

Cori Lopez Castro and David Rosendorf represent Melanie Damian, as Receiver for Onix Capital, LLC (Onix) and a number of Relief Defendants (“Receivership Entities”). The SEC  initiated this action against the Receivership Entities alleging that Onix and others violated the anti-fraud provisions of the federal securities laws by fraudulently raising millions of dollars from investors based on material misrepresentations. David and Cori have represented the Receiver in her efforts to (a) investigate and bring claims the Receivership Entities have against third parties; (b) negotiate and implement resolution of competing claims arising from a parallel Chilean insolvency proceeding; (c) implement a distribution plan that was ultimately approved by the district court; and (d) liquidate receivership assets for the benefit of investors who were defrauded by Onix.

MCM Bodily Injury victims

Cori Lopez-Castro and David Rosendorf represent the individuals who were injured or are the personal representatives or family members of individuals injured or killed (collectively, the Plaintiffs) as a result of the collapse of the pedestrian bridge which had been constructed to link the Florida International University campus to the City of Sweetwater (FIU Bridge).  Magnum Construction Management, LLC f/k/a Munilla Construction Management, LLC (MCM) was the contractor on the FIU Bridge.  There are presently twenty lawsuits against MCM and others filed in Miami-Dade County Circuit Court seeking damages from MCM and others as a result of the collapse of the FIU Bridge. Cori and David are representing the collective interests of the Plaintiffs in MCM’s bankruptcy case, including obtaining insurance proceeds from applicable carriers and assisting with the implementation of procedures for allocating the proceeds from MCM’s insurance policies among the Plaintiffs.

Group of 184 Pension Claimants (Archdiocese of San Juan)

David Samole currently represents a group of 184 pension claimants in the multi-million dollar Chapter 11 bankruptcy proceedings of the Archdiocese of San Juan as part of the Catholic Church of Puerto Rico.  He represented the pension claimants in all aspects of the Chapter 11 and related proceedings, and helped secure dismissal of the Chapter 11 proceeding now on appeal including related issues pending review before the United States Supreme Court. David has preserved and improved the pension claimants’ recovery position by representing them in Bankruptcy Court, in various levels of pending appeals and in the boardroom.

FourShore Capital, LLC

David L. Rosendorf represents FourShore Capital, LLC in connection with the potential acquisition of several Florida trucking companies which are about to file Chapter 11 petitions.  He has led the strategy as to how to structure the transaction, including purchasing secured debt, and thereafter, buying the assets as part of a §363 sale.

Beach Haus Bal Harbour, LLC

Corali Lopez-Castro and David L. Rosendorf represent the purchaser of property in Bal Harbour, Florida. A receiver appointed in State Court placed the Seller into a Chapter 11 bankruptcy and filed a fraudulent transfer action against the firm’s client, Beach Haus Bal Harbour, LLC., seeking to set aside the transfer of the property.  The case has been very litigious and involved the valuation of unique real estate assets.
