A class action complaint has been filed in the United States District Court for the Southern District of Florida against QC Franchise Group, LLC; Regencare 1142, LLC d/b/a QC Kinetix Doral; and Med-Den Funding, LLC. The lawsuit alleges that QC Kinetix and its network of Florida clinics engaged in a coordinated scheme of false and deceptive advertising to sell unproven, non-FDA-approved “stem cell” and “non-surgical regeneration” treatments to Florida consumers, while concealing material facts about the nature of those treatments and saddling patients with high-interest financing they did not knowingly agree to.
What Does the Lawsuit Allege QC Kinetix Did?
Falsely Promised a “Non-Surgical” Cure and FDA-Approved Treatment
The complaint alleges that QC Kinetix’s primary advertising strategy exploits a specific fear: the fear of invasive surgery. Their advertisements across print, television, radio, YouTube, and social media frequently juxtapose the agony and downtime of surgery with the ease and natural recovery allegedly available from their injections, using the trademarked tagline “Non-Surgical Regeneration.” According to the complaint, QC Kinetix markets its treatments as if they are scientifically validated and FDA-approved alternatives to surgery when they are neither.
Violated Florida’s Stem Cell Advertising Law
Florida Statute § 458.3245(5) requires any physician conducting stem cell therapy to include a specific mandatory notice in all advertisements, alerting consumers that the treatments have not been approved by the FDA. The complaint alleges that QC Kinetix’s Florida advertisements fail to include this statutorily required warning.
Utilized High-Pressure Sales Tactics and Predatory Financing
According to the complaint, once consumers arrive at a QC Kinetix clinic, they are subjected to a high-pressure sales process designed to extract maximum payment before patients can scrutinize the product or the price. Patients are rushed through electronic signatures without being given time to read the terms, and QC Kinetix advertises promotional financing such as “0% interest” and “$100 per month payment plans” that are not actually available to consumers, who instead receive loans carrying annual percentage rates of 9.99% or higher through Med-Den Funding, LLC d/b/a Proceed Finance.

The proposed class includes all persons who purchased non-surgical regeneration or stem cell treatments from any QC Kinetix clinic in Florida after March 2022.

The complaint seeks relief on behalf of the proposed class, including:
- Actual and compensatory damages, including the difference between the value of the treatments as promised and the value of the treatments as delivered.
- A declaration that QC Kinetix’s advertising violates Florida’s stem cell advertising statute and constitutes a per se violation of the Florida Deceptive and Unfair Trade Practices Act.
- A permanent injunction prohibiting the defendants from continuing their deceptive advertising and requiring inclusion of the mandatory statutory notice in all future advertisements.
- Disgorgement and restitution of all monies by which the defendants were unjustly enriched at the expense of the class members.
- Attorneys’ fees and costs as allowed by law.
