U.S. Farmers Pay Inflated Prices on NPK Fertilizer
The law firms of Kozyak Tropin & Throckmorton LLP; White, Graham, Buckley & Carr, LLC; Saveri Law Firm, LLP; and Clayton Jones, Attorney at Law, have filed a class action lawsuit against the largest manufacturers of NPK Fertilizer (nitrogen, phosphorus, and potassium). The lawsuit alleges that these manufacturers have colluded to fix the prices for NPK Fertilizer, causing U.S. farmers to pay inflated prices.
Inflated NPK Fertilizer Prices
This is an antitrust case about the price of fertilizer in the United States. Over the past five years, NPK Fertilizer prices have skyrocketed. While U.S. farmers have experienced a net income decrease on their farms of nearly 30%, manufacturers of NPK Fertilizer have increased their profits by nearly 300% and fertilizer prices have doubled.
The NPK Fertilizer market is controlled by a limited group of manufacturers, who control approximately 82% of the nitrogen market, 95% of the potash market and 91% of the phosphate market price of NPK Fertilizer. This concentrated market power, dominated by Nutrien, Mosaic, CF Industries, Yara, and Koch, has allowed fertilizer manufacturers to unlawfully raise and fix the price of fertilizer. This lawsuit alleges that the following companies have violated federal antitrust laws meant to protect fair competition and the free market.

Additionally, the lawsuit alleges that the NPK Fertilizer manufacturers collude using trade organizations—such as The Fertilizer Institute and the International Fertilizer Association—to share competitive sensitive confidential information that enables manufacturers to coordinate non-competitive price fixing.

The primary legal issues are whether the Defendants violated federal antitrust laws, including the Sherman Act and Clayton Act, by colluding to raise, fix, maintain, or stabilize the price of NPK Fertilizer at non-competitive levels throughout the United States.
Relief Sought for the U.S. Farmer
As alleged in the complaint, because the Defendants, through their scheme, increased the price of NPK Fertilizer far beyond the normal constraints of supply and demand, U.S. farmers have overpaid for fertilizers.
